The SURAJITPRAMANICK.COM Platform may include or contain links to any third-party websites that may or may not be owned or controlled by SURAJIT PRAMANICK. SURAJIT PRAMANICK has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. In addition, SURAJIT PRAMANICK will not and cannot censor or edit the content of any third-party site. By using the SURAJITPRAMANICK.COM Platform, you expressly relieve SURAJIT PRAMANICK from any and all liability arising from your use of any third-party website or services. You agree and confirm that you will never use another User's account nor provide access to your account to any third-party. You must notify SURAJIT PRAMANICK immediately of any breach of security or unauthorized use of your account. (iv) You agree not to use the SURAJITPRAMANICK.COM Platform for any of the commercial uses unless you obtain SURAJIT PRAMANICK's prior written approval. (v) You agree to receive installs and updates from time to time from SURAJIT PRAMANICK. These updates are designed to improve, enhance and further develop the SURAJITPRAMANICK.COM Platform & agree to receive such updates (and permit SURAJIT PRAMANICK to deliver these to you) as part of your use of the SURAJITPRAMANICK.COM Platform. (vi) You may post reviews, comments and other content; send other communications; and submit suggestions, ideas, comments, questions or other information as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringement of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any other form of spam. (vii) In your use of the SURAJITPRAMANICK.COM Platform, you will at all times comply with all applicable laws and regulations. SURAJIT PRAMANICK reserves the right to discontinue any aspect of the SURAJITPRAMANICK.COM Platform at any time with or without notice at its sole discretion.

In addition to the general restrictions mentioned above, the copyright and other intellectual property rights under the law shall apply to the Contents.

Content and Conduct
As an SURAJITPRAMANICK.COM User, you may submit User Content on the SURAJITPRAMANICK.COM Platform, including videos and User comments. You understand that SURAJIT PRAMANICK does not guarantee any confidentiality with respect to any User Content you submit. SURAJITPRAMANICK.COM Subscription
Please refer to SURAJITPRAMANICK.COM Subscription terms and conditions to know more about the terms that shall govern your subscription. SURAJITPRAMANICK.COM Subscription is exclusive for the Users who have subscribed. You shall not be given any unauthorized access or distribute or reproduce the Educational Content (as defined in the Subscription terms and conditions) to a third party. In the event that SURAJIT PRAMANICK becomes aware of any Users giving unauthorized access to any third party or distributing or reproducing any Educational Content to or any third-party channel or media, SURAJITPRAMANICK.COM reserves the right to suspend or terminate the said User�s account with immediate effect. Note: Each subscription will be valid for 15 days if not stated otherwise.

SURAJITPRAMANICK.COM Intellectual Property Right
The mark 'SURAJITPRAMANICK.COM' is the sole property of SURAJIT PRAMANICK. Reproduction in whole or in part of the same is strictly prohibited unless used with an express written permission from SURAJIT PRAMANICK.

Refunds
Any refunds that are to be processed shall be processed in accordance with SURAJITPRAMANICK.COM's refund policy. The requested refund amount will be credited to your bank account within 6-7 working days after raising the refund request.

Electronic Communication
When you visit SURAJITPRAMANICK.COM Platform or send email to us, you are communicating with us electronically. By communicating with us, you consent to receive communication from us electronically. We will communicate with you by email or posting notices on SURAJITPRAMANICK.COM Platform. You agree that all agreements, notices, disclosures, disclaimers, offers and other communications that are provided to you electronically satisfy any legal requirement that such communication should be in writing.

Termination of Account
SURAJIT PRAMANICK will terminate a User's access to the SURAJITPRAMANICK.COM Platform, if (i) The User is a repeat copyright infringer; (ii) The Users breaches any terms of these Terms and Conditions. (iii) Violation of any applicable laws; (iv) Your use of the SURAJITPRAMANICK.COM Platform disrupts our business operations or affects any other party/ User (v) You have behaved in a way, which objectively could be regarded as inappropriate or unlawful or illegal or which would bring any claims against SURAJIT PRAMANICK. (vi) SURAJIT PRAMANICK reserves the right to decide whether User Content violates these Terms and Conditions for reasons other than copyright infringement, such as, but not limited to, pornography, obscenity, or excessive length or any other parameter that SURAJIT PRAMANICK deems fit from time to time. SURAJIT PRAMANICK may at any time, without prior notice and in its sole discretion, remove such User Content and/or terminate a User's account for submitting such material in violation of these Terms and Conditions. In case any of the above-mentioned cases occur, SURAJIT PRAMANICK reserves the right, in its sole discretion, to terminate or suspend the User's account & to go for court of law procedure against the User with immediate effect.

Copyright Infringement
SURAJIT PRAMANICK operates a clear copyright policy in relation to any User Content alleged to infringe the copyright of a third party. As part of SURAJITPRAMANICK.COM's copyright policy, SURAJIT PRAMANICK will terminate User access to the SURAJITPRAMANICK.COM Platform if a User has been determined to be an infringer.

Confidentiality
You will not without obtaining prior written consent of SURAJIT PRAMANICK, disclose to third party any Confidential Information that is disclosed to you during the term of your use of the SURAJITPRAMANICK.COM Platform. For the purpose of this clause Confidential Information shall include but shall not be limited to employee details, User list, business model, processes, ideas, concepts etc. relating to SURAJIT PRAMANICK or SURAJITPRAMANICK.COM Platform which are not available in the public domain. You acknowledge and agree that the Confidential Information so provided to you shall at all-time be the property of SURAJIT PRAMANICK and any breach of the same shall cause irreparable damage to us.

Disclaimer
You agree that your use of the SURAJITPRAMANICK.COM platforms shall be at your sole risk. It does not provide you any guarantee to be successful in various examinations and others. SURAJIT PRAMANICK shall not be liable for failure to perform, or the delay in performance of, any of its obligations if, and to the extent that, such failure or delay is caused by events substantially beyond the its control, including but not limited to acts of God, acts of the public enemy or governmental body in its sovereign or contractual capacity, war, terrorism, floods, fire, strikes, epidemics, civil unrest or riots, power outage, and/or unusually severe weather. To the fullest extent permitted by law in no event shall SURAJIT PRAMANICK and persons related be liable to you for any direct , indirect, incidental , special , punitive , losses or expenses or consequential damages whatsoever resulting from any errors, mistakes , or inaccuracies of content or any other.

Indemnity
To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless SURAJIT PRAMANICK, its related persons, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the SURAJITPRAMANICK.COM Platform; (ii) your violation of any term of these Terms and Conditions; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; (iv) any claim that your User Content caused damage to a third party; or (v) violation of any applicable laws. This defense and indemnification obligation will survive these Terms and Conditions and your use of the SURAJITPRAMANICK.COM Platform.

Eligibility to use and Acceptance of the Terms and Conditions
You affirm that you are either more than 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions. If you are under 18 years of age, then please talk to your parents or guardian before using the SURAJITPRAMANICK.COM Platform.

Information Technology Act
These Terms and Conditions are published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and terms and conditions for access or usage of the SURAJITPRAMANICK.COM Platform.

Other Laws
Certain laws require to maintain data with respect to the SURAJITPRAMANICK.COM Platform and other personal information in a prescribed format and SURAJITPRAMANICK.COM will use all the information to the extent required in compliance with the applicable laws and as may be directed or amended from time to time.

Governing Law and Jurisdiction
The Terms and Conditions are governed by and constructed in accordance with the laws of India, without reference to conflict of laws principles and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.

Modification, Amendment or Termination
SURAJITPRAMANICK.COM may, in its sole discretion, modify or revise these Terms and Conditions and policies at any time, and you agree to be bound by such modifications or revisions. Your continued use of the SURAJITPRAMANICK.COM Platform post any modification of the Terms and Conditions shall be taken as your consent and acceptance to such modifications. Nothing in these Terms and Conditions shall be deemed to confer any third-party rights or benefits. If any discrepancy or confusion arises in some certain situations which does not fall under any provision / rules as mentioned above, SURAJIT PRAMANICK has the discretion to take decision in this regard and users are bound to obey such decisions.

Refund Policy
Please read the subscription terms and conditions carefully before subscribing to any of the subscription plans, as once you have subscribed you cannot change, cancel your subscription plan. Once you subscribe and make the required payment, it shall be final and there cannot be any changes or modifications to the same and neither will there be any refund. Due to some unavoidable technical reasons it may happen that amount has been debited from user's account but same has not been credited to merchant's account. In that case you may write to us with transaction ID within 48 hours from the commencement of such transaction. Before making second payment please re-check your subscription status. If you make successive subscriptions for the same item, first will get automatically cancelled & you will get the benefit of last subscription only. NB: Refund will not be entertained (if any) if you don't use your own email ID and mobile number while making payment through Razorpay and you must use your own or your family members (connected directly to you by blood relation) payment sources/credentials in order to get refunds(if any). The requested refund amount will be credited to your bank account within 6-7 working days after raising the refund request.
